MONDAY – FRIDAY: 8:00am – 5:00pm
SATURDAY: 9:00am – 4:00pm
TERMS
All Wholesale accounts are C.O.D unless credit has been approved. Our credit terms are net 30 days. If accounts are past due, a 2.0% monthly finance charge will be added. Note, payments will be applied to the oldest invoices/items unless a remittance slip is included stating invoices to be paid.
A fee of $35.00 will be charged on each returned check.
If a legal suit is instituted to enforce collection of accounts past due, buyer agrees to pay reasonable attorney fees and all costs of suit.
NOTE TO OUR WHOLESALES & YOUR CLIENTS:
We welcome the business of both you and your customers. You are welcome to bring your customers to our yard and show them various products. However, if our Sales Staff assists your customer (in your absence) a 20% walking fee will be added to the price of the products.
WARRANTY & CLAIMS
We give no warranty implied as to the productiveness of life of the nursery stock we sell. We shall in no case be liable for any sum greater than the amount originally received for said nursery stock. All claims, for error or unacceptable stock or any other reason, must be reported within 48 hours of receipt of plants and confirmed in writing within (5) days or shall be deemed waived. Please note, we give no warranty on replacement stock.
LOADING / DELIVERY
YOU are solely responsible for counting all products as it is being loaded. Once you leave any shortages cannot be verified or honored. As a wholesale customer and/or contractor you are also solely responsible to know “your” specific truck’s requirements and or restitutions.
If loading is requested and/or our equipment needed, you hereby agree to be primarily liable for, and to defend, indemnify and hold harmless, ADAMS NURSERY & GARDEN CENTER, LLC from and against all claims, actions and /or damage incurred.
When picking up your orders, please bring a tarp to protect your plants in transit on open trucks.
We also have tarps available for purchase.
SPECIAL ORDERS:
All orders that are placed, MUST be picked up or delivered within 5 to 7 days of the materials being delivered to the nursery.
HOLDS /LAYAWAYS:
PLEASE note all orders placed on Hold/layaway must be picked up within 5 days from the date the material was requested and put on hold/ layaway.
ANY plants or material held beyond that time is subject to being placed back in to stock and/or sold without notice.
Note: If special circumstances are needed for extended hold time they must be approved by the owners, either Maryjo or Steve.
PLANT – PATENT NOTICE
Any asexual reproduction or distribution by sale, gift, or otherwise, of scions, bulbs, or cutting for reproduction of any plant without a written license granted by the patent holder, constitutes an infringement of such patent, which will subject infringer to prosecution under Patent Laws.
CERTIFICATION OF STOCK
All stock is inspected by the New York State Department of Agriculture.
